Regulation UE On Foreign Direct Investment Comes Into Application

As of 11 October 2020, EU Regulation 2019/452 of 19 March 2019 on the control of foreign direct investment is directly applicable in Italy. The aim of this Regulation is to establish a common system among Member States of the European Union in order to monitor foreign investment. With this Regulation, the European Union establishes ad hoc screening mechanisms over operations with a potential impact on security and public order in the territory of the Union and provides for an additional measure to protect strategic activities.

EU Regulation 2019/452 will have a significant impact on the procedures already in place at national level regarding the special powers of the Government with regard to foreign investments (so-called “Golden Power”), which have become increasingly important in recent times, also in the light of emergency regulations.
