After the EU extended the actionability of the EU Directive 2001/55 on Temporary Protection, for the consistent Ukrainian community escaped in Italy the only question remaining was related to their residence permit: the validity of said permit, in fact, was due to expire in the first week of March 2023, and no news were available on how that would be extended or renewed.
The Italian Council of Ministries approved a Law Decree on February 23rd, 2023, in which, with urgency, the previous dispositions in regard to the Ukrainian emergency are prorogated, in particular in relation to:
- widespread reception through Municipalities, third sector and religious entities, voluntaries and entities already identified in the Legislative Decree 286/1998;
- assistance to people entitled to the “Temporary Protection” who found an autonomous accommodation in Italy;
- social services offered by the Municipalities that have a significant number of beneficiaries of the “Temporary Protection”;
- extension to December 31st, 2023, of the validity of the residence permit for “Temporary Protection”, unless in case of ceasing of the applicability of the EU Directive on Temporary Protection mentioned above.
Moreover, the Emergency State has been prorogated, for this situation, to December 31st, 2023, too.
As of today’s date, it is still unclear whether it will be an automatic extension or holders of a Temporary Protection residence permit will be required to undertake a specific renewal process and, in such a case, what would be the practical steps that they will need to take.
