Our International Trade and National Security team (“LCA-ITNS”) advises its clients operating into several Industries in the following main areas:
- Foreign Direct Investment (FDI) in the context of Italian and cross borders acquisitions and operations (both commercial and corporate) in those industries qualified as “strategic sectors” by EU FDI Regulation and Italian FDI Golden Power Law system, such as, National Security and Defense, 5G, Cybersecurity and Cloud Communication Systems, Energy, Transportation and Telecommunications, Health, Agri-Food, Data, Media, Water, Chemical, Biotech, Banking Insurance and Financial Market, AI and Robotics, Aerospace, Strategic Raw Materials, Dual Use, and related industries and strategic assets.
- International Trade Sanctions and Dual Use a multi-practice area covering all aspects of terms, conditions, limitations and authorization in the complex area of international trade with a special focus to Sanctions to Russia, Belarus and Iran and high skills on Dual Use matters including Internal Compliance Programs and impact of Dual Use rules and their effects of Sanctions and FDI.
Our experience adopts efficient and practically over-the-years-tested – also by confronting with the public authorities – working tools for the analysis of the cases, the assessment of the risks, the preparation of any relevant applicable filing forms and associated documentation; LCA-ITNS experience also includes several governmental and other public authorities’ hearings and regulatory and administrative court litigation cases.
We gained a high level experience on corporate and regulatory aspects of above areas, including the relevance and the impact of the regulatory framework on M&A structure, commercial risks, internal compliance aspects and criminal and quasi-criminal risks.
